Terms of service

1. Who we are

TagDuck ("TagDuck", "we", "us") is operated by Pavlo Usarskyi, a sole proprietor registered in Poland, NIP 6793122131. These Terms are governed by Polish law, and any dispute not resolved informally is subject to the jurisdiction of the competent Polish courts.

2. Acceptance of these terms

By accessing or using TagDuck ("the Service"), you agree to be bound by these Terms of Service and all policies referenced herein, including our Privacy Policy. If you do not agree, do not use the Service.

3. Description of the service

TagDuck is a web-based tool that uses AI to generate SEO metadata — descriptions, keywords, filenames, and geotags — for uploaded photographs, and embeds that metadata directly into the image files. Output is delivered to you for download. TagDuck does not publish, host, or distribute your content anywhere — what you do with the processed files afterward is entirely up to you. Photos are analysed by third-party AI providers to generate this metadata — see our Privacy Policy for details.

4. Attribution metadata added to every image

Every photo processed by TagDuck includes a small attribution tag identifying TagDuck as the tool used to generate its metadata — standard practice among similar tools, applied automatically and not something you can disable. It does not replace or alter any photographer, copyright, or credit information, which remains entirely under your control.

5. Accounts & eligibility

You are responsible for maintaining the confidentiality of your account credentials. You may not share accounts or use the Service to process content on behalf of third parties without their consent.

6. Subscriptions, billing & credit packs

Subscription fees are billed monthly in advance. Credit packs are one-time purchases and never expire; they extend your monthly image quota but not your per-batch upload limit. Monthly image quotas reset at the start of each billing cycle and unused quota does not carry over. Credit pack credits carry over indefinitely.

Payments are processed by our payment provider, who acts as Merchant of Record — meaning they are the seller of record for your purchase and handle applicable VAT/sales tax. Billing management, plan changes, cancellation, and invoices are handled through their customer portal, accessible from your Account page. Refund requests are handled case by case — contact us at the email below.

7. Acceptable use

You may not use the Service to:

• Process content that depicts minors in a sexual or exploitative context.
• Process content you do not have the rights or permission to process.
• Violate any applicable law or regulation.
• Attempt to reverse-engineer, scrape, or probe our AI systems or infrastructure.
• Interfere with the availability or integrity of the Service.

Uploaded content also passes through our AI providers' own content moderation, which may reject certain images independently of these Terms.

8. Content & intellectual property

You retain all rights to your original photos. You grant TagDuck a limited, non-exclusive licence to process your photos solely for the purpose of generating metadata. The generated metadata output belongs to you. Where a feature lets you supply licensing or attribution information to be written into your files, you are solely responsible for its accuracy — TagDuck writes it as instructed but makes no representation as to its legal effect. TagDuck retains rights to anonymised, aggregated usage data used to improve the Service.

9. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. TagDuck does not guarantee that AI-generated metadata is accurate, complete, or suitable for any particular purpose, and you are responsible for reviewing output before relying on or publishing it. To the maximum extent permitted by law, TagDuck's aggregate liability for any claim is limited to the fees you paid in the three months preceding the claim.

10. Data retention & termination

Uploaded photos and their generated metadata are retained only for a limited period after your last activity, then automatically and permanently deleted. See our Privacy Policy for details.

You may close your account at any time from your account settings. We may suspend or terminate your account for violation of these Terms. Once your account is deleted, we retain your data for a short grace period before it is permanently and irreversibly purged.

11. Changes to these terms

We may update these Terms at any time. Continued use of the Service after changes take effect constitutes acceptance.
